The Saskatchewan Employment Act does not provide for a specific leave called sick leave. But it also provides qualified employees with personal illness or injury or the unpaid, job-secured absence of a family member.

Employers may not dismiss or discipline an employee for making use of this absence from work due to illness or injury.

Employee's eligibility for lost work due to illness or injury

If an employee has worked for an employer for more than 13 consecutive weeks, the employer cannot dismiss or penalize the employee for absence due to illness or injury if:

An absence is 12 or fewer days in a calendar year for an illness or injury that is not serious.

absence is due to serious illness or injury, but does not exceed 12 weeks in a 52-week period; either.

The injured worker is receiving benefits under the Workers' Compensation Act, and the absence must not exceed 26 weeks within a 52-week period.

Employers can provide employees with benefits higher than those provided in employment standards law, but they cannot provide less than the minimum standards.
